課程概述 |
氣候變遷及其所造成的極端氣候，已經成為全球所必須共同面對的嚴峻課題。從1992年的氣候變化綱要公約、1995年的京都議定書，到去（2015）年底剛通過的巴黎協議，在在反映出全球各國對此一議題在規範上的態度與立場。本學期的課程希望透過對於國際規範不同的研究取向（利益本位 v. 規範本位），來分析氣候變遷國際規範機制的型塑與變遷。
本學期的課程主要分為三個部分。第一部分是對於國際規範主要研究取向的閱讀及分析。第二部分則聚焦在氣候變遷相關的國際規範機制，透過不同研究取向的文獻來理解氣候變遷國際規範機制的型塑與變遷。最後則是要求修課同學必須選取這些不同的研究取向，來提出對於氣候變遷規範機制型塑與變遷的分析，並以此來撰寫學期報告(reflection paper)。

課程目標 |
本課程是針對法律學院碩士班的同學所設置，希望能達到以下三項目標。首先，本課程希望增加修課同學對國際法的認識與理解。這門課從全球面向出發，希望能在全球化的脈絡下，增加修課同學對國際法的認識。當代國際規範已在全球化的脈絡下走向多元。修課同學不僅必須能理解到此一趨勢，而且要能理解在環境法的議題上，多元行動者(actors)如何影響與形塑國際法的內涵。
其次，本課程希望同學透過閱讀課程文獻，能整合國內外既有的相關研究。本課程所指定與要求的課堂讀物，除了包括既有的外國文獻，也包括國內相關學者的研究成果。透過課程進度的安排，修習課程的同學除了能掌握現有的讀物之外，也能將國內外的相關研究以議題討論的方式，加以連結及整合。
最後，本課程希望結合法學院現有的研究資源，推展相關研究的進行。由於本課程開設的對象主要是法學院碩士班的同學，因此除了理解國際環境法的內涵之外，我們的課程最終還是希望能結合法學院既有的研究資源，觸動同學對相關議題研究的興趣。法學院自2009年起即設立了「環境永續政策與法律研究中心(PLES)」，並已持續發展與研究與環境相關的各種政策與法律。本課程最終希望能誘發同學在既有的研究資源與成果上，繼續發展國際環境法律與政策的相關議題。

課程要求 |
本課程將非常重視學生的課堂討論與參與。修課同學必須在每次上課前閱讀指定資料，並參與課程討論。學期成績將以上課參與及報告（50%）以及期末報告（50%）綜合評量核算。 |
